MILWAUKEE XC5 WIN A VAN
Terms and Conditions (the “Agreement”)
1. The Milwaukee XC5 Win A Van ("Promotion") is promoted by Techtronic Industries (UK) Limited with company number 02478762 and whose registered address is Suite A, Second Floor, Parkway, Marlow, Bucks, England, SL7 1YL ("Promoter").
2. By entering this Promotion, participants will be deemed to have accepted this Agreement. Participants in the Promotion will be subject to the Milwaukee website terms of use of the Milwaukee UK website [https://uk.milwaukeetool.eu/footer/terms-of-use/] the Milwaukee MyAccount terms of use available here: [https://uk.milwaukeetool.eu/footer/my-account-terms-of-use/] and participants personal data will be processed in accordance with the Promoter's privacy statement available at: [https://uk.milwaukeetool.eu/footer/privacy-policy/].
PROMOTION
3. The Promotion begins on 14th September 2026 at 00:01am and ends 30th November 2026 11.59pm ("Promotion Period").
4. Participants who, during the Promotion Period, purchase a Milwaukee XC5 battery in store or online from one of Milwaukee Authorised Distributors (https://uk.milwaukeetool.eu/support/store-locator/ ) in the United Kingdom are entitled to enter this Promotion, subject to the terms and conditions herein.
5. All entries must be received by us, regardless of when they are sent, by 30 November 2026 11.59pm in accordance with the entry process set out below to be eligible for this Promotion.
6. Participants may only make one valid claim per proof of purchase including an XC5 battery purchase. Any attempt to make multiple claims per proof of purchase will be void.
7. Participants may make multiple entries during the Promotion Period. Each entry must be based on a different proof of purchase including a XC5 battery.
8. All purchases of XC5 batteries must be new and genuine Milwaukee products purchased from a UK Milwaukee Authorised Distributors. Purchases of second hand, refurbished or reconditioned products, and purchases from auction websites (e.g. eBay) or from third party sellers that are not participating UK Milwaukee Authorised Distributors, including sales on online retailers' websites (e.g. Amazon and Amazon Marketplace) as well as products imported from outside the UK or EEA or products which are counterfeit or infringe the intellectual property rights of the Promoter in any way will not qualify for this Promotion.
ELIGIBILITY
9. The Promotion is available to residents of the United Kingdom who are aged 18 years or over at the beginning date of Promotion Period. Deliveries will only be made to addresses in the United Kingdom. Delivery will be via a specialist courier. If the XC5 battery is purchased in the United Kingdom by a Participant that is resident outside the United Kingdom, this entry will be void. The Promotion will be void and non-applicable where prohibited by law and where it is necessary to do so.
10. Employees, officers and directors of Promoter and its affiliated companies are not eligible to participate in the Promotion. Any such entries will be deemed as void.
11. To be eligible to participate in the Promotion participants must have registered to Milwaukee MyAccount [https://uk.milwaukeetool.eu/account/login/?returnUrl=/account/dashboard/] at the time of entry. Entries submitted without an active Milwaukee account will be deemed invalid.
12. The Promotion is only available to participants who purchase a Milwaukee XC5 Battery from a UK Milwaukee Authorised Distributors as an end user. Retailers or rental companies are expressly excluded from entry.
13. Entries from organised groups, third parties, agents, macros or other automated means, will not be eligible. Incomplete applications or applications that are not in accordance with this Agreement or the application instructions will be rejected.
14. Tools Kits created by dealers and free of charge batteries are not eligible for entry.
15. This Promotion does not apply to any non-listed Milwaukee products during the campaign or any products purchased outside of the Promotion Period.
ENTRY PROCESS
16. To enter this Promotion, once participants have purchased a Milwaukee XC5 Battery from a UK Milwaukee Authorised Distributors within the Promotion Period and signed up for a Milwaukee account here: [https://uk.milwaukeetool.eu/account/login/?returnUrl=/account/dashboard/] an entry form must be completed and submitted online before the end of the Promotion Period using the following link [https://uk.milwaukeetool.eu/promotions/portal/uk/xc5-van-giveaway/]. Participants must upload a fully legible copy of the purchase receipt as part of the entry. The uploaded proof of purchase must display all required information, being the model number and/or description of the XC5 battery purchase, the price paid for the XC5 battery, that the XC5 Battery was purchased from a UK Milwaukee Authorised Distributors, a picture copy of the barcode on the receipt and the date of purchase.
17. Participants must submit their entry within the specified promotional Promotion Period. Any entries submitted before or after the Promotion Period will be invalid.
18. Once a participant has submitted their entry, an email acknowledging receipt of the entry will be sent to the email address the participant has provided, which will include details of the entry and a unique reference number.
19. Any entries made in respect to the purchase of an XC5 Battery that are subsequently returned to the retailer for any refund are deemed void, and the Participant must immediately notify Promoter at [email protected] to cancel the entry.
20. The Promoter reserves the right to verify with a Milwaukee Authorised Distributors the eligibility of all claims to protect itself against fraudulent, invalid or repetitive claims including, without limitation, to require the participant to prove that it did not return the product within the period of 30 days from the date of purchase. Claims for returned products, bad faith or fraudulent entries or claims that otherwise do not meet the terms under this Agreement, will be invalidated and the participant will not be entered into the Promotion
21. All entries must include the participant's full name, email address, telephone number and a valid delivery address in the United Kingdom. The Promoter will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the participant from or otherwise obstructs the participant to enter in the Promotion. Entries made by fax, telephone or post will not be accepted. Incomplete entry forms will be deemed void, as will claim forms not completed in accordance with this Agreement.
22. Online entry is free however internet connection and mobile data rates may apply to the participant. The cost of accessing the promotional website will be dependent on the participant's individual internet service provider and shall be the responsibility of the participants only. Promoter holds no liability to cover entrance costs.
PRIZES AND WINNERS ANNOUNCEMENT
23. There is one (1) Prize available to win, details at Annex 1.
24. The one (1) winner will be chosen at random using a computer-generated selection by the Agency/Promoter from all valid and correct entries. The winner will be contacted by 31st December 2026. No fee is payable to claim the Prize.
25. If the winner cannot be contacted or does not claim the Prize within fourteen (14) days of notification, the Promoter reserves the right to withdraw the Prize from the winner and select a replacement winner. The Promoter shall have no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.
26. The Promoter will deliver the Prize via special courier to the specified United Kingdom address. Alternatively the winner may collect the Prize from the UK Milwaukee Experience Centre at a date and time confirmed by the Promoter.
27. The Prize is non-exchangeable, non-transferable and there is no cash, credit, or product alternative available. In the event of unforeseen circumstances, the Promoter reserves the right to provide an alternative Prize of the same or greater value.
28. The winner shall be solely responsible for arranging and maintaining, at their own cost, valid motor insurance for the Prize in accordance with applicable law. The Promoter shall not deliver or release the Prize for on‑road use until the winner has provided satisfactory evidence of such insurance. The Promoter shall have no liability for any loss arising from the winner’s failure to obtain insurance.
29. The winner (or any person who will drive the Prize at or after delivery/collection) must hold a current and valid driving licence of the appropriate category and meet any insurer eligibility criteria. The Promoter may require proof of identity, age and driving licence prior to handover. If the winner cannot satisfy these requirements within fourteen (14) days of request, the Promoter may withdraw the Prize and select a replacement winner in accordance with this Agreement.
30. Unless expressly stated otherwise in Annex 1, the winner shall be responsible for all costs and formalities required for lawful on‑road use of the Prize after handover, including vehicle registration (V5C), vehicle excise duty (road tax), any first registration fee, number plates and, if applicable, MOT. Where the Prize is supplied new, the Promoter may arrange first registration and provide the winner with details at or before handover; any ongoing VED and MOT obligations thereafter shall be the sole responsibility of the winner.
31. Delivery shall be to a United Kingdom address via specialist courier or collection from the UK Milwaukee Experience Centre, as notified by the Promoter. Risk in the Prize shall pass on delivery/collection. Title shall pass at the same time, subject to verification of eligibility and receipt of satisfactory insurance evidence.
32. All running and ownership costs of the Prize are the sole responsibility of the winner, including without limitation fuel, insurance premiums, servicing, maintenance, replacement parts and tyres, parking, tolls, congestion and ULEZ charges, fines and penalties.
33. If the winner fails to provide required documentation or to satisfy the insurance/licence requirements within the time specified by the Promoter, the Promoter may withdraw the Prize and select a replacement winner in accordance with this Agreement.
34. The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.
GENERAL CONDITIONS
35. Personal data relating to the participants will be used for the purposes of this Promotion in accordance with applicable data protection legislation and the Promoter's Privacy Statement available at [https://uk.milwaukeetool.eu/footer/privacy-policy/]. The Promoter has appointed Vario Press Limited as its third-party fulfilment provider for the Promotion. The Promoter has appointed Bubblehouse as its third-party provider validate your entry and select the winner. If participants give their consent to the processing of their personal data for Promoter's marketing purposes, the Promoter reserves the right to contact them regarding various Milwaukee product and service promotions or other related communications. Participants can withdraw consent to such use of personal information by writing to Promoter at the email address set out above or by using the opt-out link in the promotional emails.
36. The Promoter shall not be liable for any disruption to the Promotion whether due to force majeure or other factors beyond the Promoter's control.
37. In accordance with all relevant legislation and codes of practice, the Promoter reserves the right to suspend or modify this Promotion. If such modification or suspension occurs, Promoter will post a notice of such on Promoter's website as soon as is practically possible.
38. To the extent permitted by law, Participants agree to release and hold the Promoter harmless from any and all liability whatsoever for any losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Promotion. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter's negligence.
39. This Promotion is not available in conjunction with any other offer or promotion.
40. If the Prize is taxable then the Participant is responsible for ensuring the necessary reporting and payment of any applicable tax on the value of the Prize to the relevant tax authority.
41. If any provision of this Agreement is held invalid by any law or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
42. This Agreement is governed by the Laws of England and Wales. The place of jurisdiction for all legal disputes is England and Wales.
