Christmas Promotion Box Terms and Conditions

1. 1. THE PROMOTER 

2. 1.1 The Milwaukee® Christmas promo competition 2023 ("Promotion") is promoted by Techtronic Industries (UK) Limited, whose registered address is Suite A, Second Floor, Parkway, Marlow, Bucks, England, SL7 1YL ("Promoter").  

3. 1.2 Participation into the Promotion is deemed acceptance of this Agreement. Participants will be subject to the terms of use of the Milwaukee® website found here [MILWAUKEE® Power Tools UK Official Site | NOTHING BUT HEAVY DUTY | Milwaukee Tools UK] and the participant’s personal data will be processed in accordance with the Promoter's privacy policy available at [MILWAUKEE® Power Tools UK Official Site | NOTHING BUT HEAVY DUTY | Milwaukee Tools UK].

5. 2. ELEGIBILITY 

6. 2.1 This Promotion is open to any resident of the United Kingdom over the age of 18 years at the date of entry.  

7. 2.2 Employees, officers and directors of Techtronic Industries (UK) Limited and its affiliated companies or their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion shall not be permitted to enter the Promotion, any such entries will be deemed as void. 

8. 2.3 Participants are responsible for ensuring that they are entitled to participate and proof of eligibility may be required and prizes withheld until Promoter is fully satisfied the above criteria are met.  

9. 2.4 There is no entry fee and no purchase necessary to enter this Promotion; although internet connection and mobile data rates may apply to the participant. The cost of access to the Promotion website will depend on and shall be the sole responsibility of the participant’s internet service provider. The Promoter is not responsible for the participant's costs. 

10. 2.5 By entering this Promotion, a participant indicates that he accepts and agrees to these conditions.

12. 3. HOW TO PARTICIPATE 

13. 3.1 The Promotion begins at 00:01 on 1st October 2023 and ends at 11:59pm on 31st October 2023 (the “Promotion Period”).  

14. 3.2 To participate in the draw, participants can subscribe to the Milwaukee Heavy Duty News™  via the pop-up form which will be displayed to users after thirty (30) seconds of activity on the website. For the avoidance of doubt, individuals may join the mailing list and subscribe the newsletter without being a part of the Promotion through the following link [Sign up for the Milwaukee Tool Newsletter | Milwaukee Tools UK]. 

15.            3.3 To subscribe to the Milwaukee Heavy Duty News™  : 

    i. All participants must enter their email address and accept the subscription to the database, as well as the T&C's and the privacy policy of the Promotion by populating their information within the pop-up form ("Pop-up Form”). 

     

    ii. All participants will then receive a confirmation email to the email address provided via the pop-up form.  

     

    3.4 A prize will be awarded to ten (10) winners chosen at random at the end of the Promotion Period (see Annex 1). 

     

    3.5 The winners of the draw will receive the prizes indicated in Annex 1. 

     

    3.6 The winners will be randomly selected from all correct entries on 1 November, 2023. 

     

    3.7 Mass registrations made by the merchant, consumer groups, trade unions or the like will not be accepted. Cheating of any kind will not be accepted, including the use of macros or other automated means of participation, identity masking by manipulating IP addresses, using any false identity or any other behavior that falls outside the spirit of the promotion (to be determined in our absolute discretion). Any participant who cheats will be excluded. 

     

    3.8 Participants that attempt to submit multiple entries by unsubscribing and resubscribing to the newsletter via the pop-up will not be accepted.  

     

    3.9 The Promoter accepts no liability for entries that have not been received, deleted, altered or invalid, for any reason not attributable to it. 

     

     

    4. PRIZES AND WINNERS ANNOUNCEMENT  

     

    4.1 The winners will be chosen at random by computer-generated selection by the Promoter from all valid and correct entries from 1 October 2023 to 31st October 2023. The winners will be announced no later than 1 November 2023. The prize will be delivered within thirty (30) working days from the date the winner provides their postal address to the Promoter.  

     

    4.2 The winner will be notified by email where the Promoter will request a UK delivery address for the shipment the prize. If a winner cannot be contacted or does not claim the prize within fourteen (14) days of notification, the Promoter reserves the right to withdraw the prize from the winner and select a substitute winner. The Promoter shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.  

     

    4.3 Promoter is not responsible for inaccurate prize details supplied to any participant by any third party connected with this Promotion and no cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of similar characteristics and value without giving notice.  

     

    4.4 The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.  

     

16. 5. DATA PROTECTION 

17. 5.1 Personal data relating to the participants will be used for the purposes of this Promotion in accordance with the current GDPR legislation and the Promoter’s Privacy Policy found at MILWAUKEE® Power Tools UK Official Site | NOTHING BUT HEAVY DUTY | Milwaukee Tools UK. The Promoter reserves the right to contact all participants to verify their personal data. For the avoidance of doubt, any entry made in relation to the Promotion as set out at Clause 3 will be deemed to have given consent for the Promotor to process all personal data.

19. 6. GENERAL 

20. 6.1 Promoter reserves the right to cancel or amend the Promotion and these terms and conditions without notice at any time. Any changes to the Promotion will be notified to participants as soon as possible by Promoter.   

21. 6.2 The Promotion and these terms and conditions will be governed by law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. 

22. 6.3 If any provision of these terms and conditions are held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid. 

23. 6.4 Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the recipient or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the decal sticker except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
